Terms of Service

1. Subject of the service

workshopfotografico.com is an editorial platform and a community dedicated to glamour and fine-art nude photography: it publishes live workshops and events, video courses and models' promotional profiles. The owner is Massimiliano Uccelletti (VAT 09470951006), Viale Stefano D'Arrigo 79, 00131 Rome, Italy.

2. Minimum age

The site publishes artistic photography, including fine-art nude work. As a simple precaution, access is reserved for adults: by registering you declare that you are at least 18 years old.

3. Account and registration

Registration is free. You are responsible for keeping your credentials confidential and for the activity carried out with your account. The data you provide must be truthful and up to date.

4. User roles

Registered: access to free content.
Supporter: paid access to reserved content (e.g. video courses and attachments).
Model: publishes and manages their own promotional profile.

5. Supporter subscription: withdrawal, digital content and refunds

The Supporter membership lasts 12 months, requires a single payment and does NOT renew automatically. It grants immediate access to reserved digital content and services (video courses, downloadable attachments, MaXu's complete high-resolution portfolio, and the models' reserved contacts and galleries). Accepted payment methods are shown at activation (PayPal, bank transfer, coupon). The platform does not store payment card data.

If you act as a consumer under the Italian Consumer Code (Legislative Decree 206/2005), you are in principle entitled to withdraw within 14 days of concluding the contract, without giving a reason. However, as this concerns digital content available immediately, at the time of purchase you make two separate declarations via dedicated consent checkboxes: (a) you expressly request that supply begin before the end of the 14-day period; (b) you acknowledge that, once performance has begun, you will lose the right of withdrawal in respect of such digital content, pursuant to art. 59(o) of the Consumer Code. After purchase you receive an email confirmation on a durable medium, summarizing the membership and the consents given, with the date and time of activation.

Refund policy: once access to the digital content has been activated following the consents above, the amount paid is not refundable on a change-of-mind/withdrawal basis. The consumer's mandatory statutory rights remain unaffected in any case, in particular the legal guarantee of conformity (artt. 135-bis ff. of the Consumer Code): should the content be defective, not as described, or inaccessible due to a cause attributable to the platform, you are entitled to having conformity restored or, where the conditions are met, to a price reduction or refund as provided by law. The right of withdrawal also remains in the other cases provided for by applicable law. For any request write to maxu@workshopfotografico.com, indicating your purchase details.

6. Models' content

Anyone creating a profile declares to be of age and to hold the rights to the uploaded content, authorising its publication on the site. The profile photo must contain no nudity or censorship. Publishing fine-art nude photographs in the reserved portfolio requires a dedicated, specific consent, given by the model through a dedicated checkbox in her panel and separate from the general release. Content may be removed at any time on the data subject's request or in case of violation.

7. License to user-uploaded content

The user (in particular the model) retains ownership of the rights in the content they upload (text, photographs and other materials): the Operator does not claim ownership. By uploading content, the user grants WorkshopFotografico.com a non-exclusive, free license to host, reproduce, store, technically adapt, publish and display the content, for the purposes of: (a) publishing the profile according to the visibility settings chosen by the user; (b) promoting the platform and its events, including on social media. Promotional use is limited to public photos; reserved-portfolio and fine-art nude photos are not used for external promotion unless a further specific consent is given.

The license is valid without territorial limits (use on the Internet) for as long as the content remains published and as necessary to provide the service. It is revocable: the user may modify or remove their content, or reduce/withdraw its visibility, at any time using the available features. Revocation takes effect for the future and does not affect uses lawfully made before it; technical copies, backups and legal-defense needs are reserved. Any external promotional materials already distributed before revocation (e.g. social posts) are not automatically affected, but on your request we will endeavor to remove those still under our control. The user is solely responsible for the content uploaded, warrants that they own it or hold all necessary rights and releases, and indemnifies the Operator against third-party claims. 8. Profile visibility and consent

The data, photos and contacts you enter are private by default and become visible to other users only for what you explicitly choose to share: a photographer decides whether and through which channels (e.g. Instagram, email) to be contacted by models; a model decides which information and photos to show and to which categories of users. No data is shared without your explicit indication and you can change or withdraw these choices at any time from your personal area. By making these choices you give consent to the corresponding visibility, which we record for evidence purposes.

9. Intellectual property

All content (photos, texts, videos) is protected by copyright and belongs to its respective owners. Downloading, copying, redistributing or using the images outside the features provided by the site is prohibited.

10. Prohibited conduct

It is forbidden to use the site for unlawful purposes, harass other users, attempt to access reserved areas without authorisation, or circumvent the content-protection measures.

11. Live events (workshops, Shootout, remote events, LiveStage)

The platform promotes live events, «remote» events, the Shootout Italia project and events on the LiveStage platform. Participation in paid events requires booking and payment according to the methods and prices stated on each event's page; places may be limited and registration is completed only once payment is confirmed. The conditions for cancellation, refund, postponement (including for adverse weather at outdoor events) and any transferability of the registration are stated on each event's page at the time of registration. If the organizer cancels the event, the participant is entitled to a refund of the amount paid or, where offered, to transfer to a later date.

The organizer may change the program, instructors, models, schedule or format for organizational, technical, health, safety or force majeure reasons; announced models may be replaced by others of equivalent profile (the presence of a specific model is not an essential condition of registration, unless expressly stated otherwise). Photographs are taken during events: commercial use, publication and distribution of images depicting people require the necessary releases from the subjects, for which the participant is responsible. Unless authorized, audio/video recording of the event is prohibited. Respectful and professional conduct is required on set: harassment, unsolicited contact, sexual advances or intimidating/discriminatory conduct lead to removal without refund, without prejudice to any legal remedy. Each participant is responsible for their own equipment.

LiveStage events: LiveStage is a platform external to and independent from WorkshopFotografico.com (iOS/Android app). WorkshopFotografico.com does not operate, and is not operated by, LiveStage, and does not control its services. Events held on LiveStage — registration, access to streaming, chat and release management — take place entirely on that platform, outside WorkshopFotografico.com and under the sole responsibility of the user and of the LiveStage platform, in accordance with the terms made available by LiveStage itself.

12. Limitation of liability

The service is provided «as is» and «as available». While we make reasonable efforts to ensure continuity, security and accuracy, we do not warrant the absence of interruptions, errors, delays or defects, and we are not responsible for content published by users. To the extent permitted by law, the Operator is not liable for indirect, consequential or unforeseeable damages, nor for damages arising from the acts, content or conduct of users or third parties, from the misuse of data visible through the platform, or from temporary interruptions of the service.

The mandatory rights granted to the consumer by law are expressly reserved, in particular the guarantee of conformity of goods, digital content and digital services provided for by the Consumer Code. Nothing in these terms excludes or limits the Operator's liability for willful misconduct or gross negligence, for death or personal injury attributable to it, or in any case where such exclusion is not permitted by law.

13. Suspension and closure

We may suspend or close an account in case of breach of these terms. You may request the closure of your account at any time.

14. Governing law

These terms are governed by Italian law. For consumer relations, the court of the consumer's place of residence or domicile has jurisdiction.
